NEW IMPASSE PROCEDURES

As of July 10, 2003 

·        Boards are now prohibited from imposing their last best offer when postfactfinding negotiations fail to produce a negotiated agreement.

§ Factfinding is now a statutorily mandated step of the impasse process.  The law now requires the public release of the factfinding report 10 days after the recommendations are received by the parties. 

§        Super conciliation is now a required step of the impasse process, if the parties are unable to reach agreement within 20 days after the issuance of the factfinder’s report.  If the super conciliation process fails to yield a settlement, the super conciliator is to issue a recommendation, which is to be released to the public within 10 days of its receipt by the parties.
