The School Ethics Commission has adopted a number of decisions finding violations of the act, and it has recommended penalties for those board members who failed to adhere to their prescribed ethical mandates.

Last week, the New Jersey Appellate Division affirmed the commissioner of education’s decision that a board member violated the School Ethics Act, N.J.S.A. 18A:12-21 et seq. when he filed a petition with the commissioner without approval by the whole board.

Specifically, two of these decisions further clarified a code of ethics that states, “I will recognize that authority rests with the board of education and will make no personal promises nor take any private action that may compromise the board.”
