Employment  Arbitrator reinstated teacher who was alleged to have used profanity in front of students. Arbitrator determined that district’s charges were based on unreliable hearsay. Arbitrator determined not to sustain charges of unbecoming conduct where teacher failed to notice and remove profanity written by students on classroom posters, where teacher who shared the classroom was not disciplined. Arbitrator noted that teacher should have had the opportunity to cross-examine student witnesses following an alleged classroom incident. Arbitrator determined that written statements by students were unreliable hearsay where administrators who gathered the student statements did not indicate the circumstances under which they were obtained.
