New Jersey Department of Education Updates its Parental Rights in Special Education, Annotated Written Sample Written Notice Documents

In a July 1 broadcast memo, the New Jersey Department of Education announced revisions to their Parental Rights in Special Education (PRISE) booklet and associated state-level special education documents. Specifically:

• The PRISE updates
  • provide clarification on the initiation of an action proposed by a school district following the provision of written notice (p. 3); and
  • address emergent relief (pp 21-22) and settlement agreements (p 24) as part of due process requests.
• The NJDOE also updated its Annotated Sample Written Notice to provide a more detailed explanation of the Department’s regulations regarding a parent’s rights when they disagree with an LEA’s proposal. The revisions are designed to ensure that parents are fully informed of their available protections under IDEA Part B whenever an LEA proposes to initiate or change a student’s identification, evaluation, placement, or the provision of FAPE.

The updated Annotated Sample Written Notice may be found here; the updated PRISE, which supersedes all previous editions and must be the primary document provided to parents as required under federal regulations, may be found here.
